“Public Nuisance Claims Against Building Product Manufacturers”
Presented by Thomas McMahon, Howrey LLP

February 20, 2007
1 p.m. EST, 1 hour
$199 per person

The latest trend in product liability law is government agencies bringing “public nuisance” lawsuits seeking “abatement” of the nuisance. Lead paint manufacturers have become a recent target of this approach. However, any company that manufactures a product incorporated into a construction project that is later deemed hazardous to human health could face liability under this theory. Because the plaintiff is a government agency rather than an individual, proof of a scientific exposure and injury may not be required.
