ACD Releases Statement on IEEPA Tariff Oral Arguments Before Supreme Court

Today, Alliance for Chemical Distribution (ACD) President and CEO Eric R. Byer released the following statement after oral arguments concluded before the U.S. Supreme Court (the Court) on the consolidated cases of Learning Resources, Inc. v. Trump and V.O.S. Selections, Inc. v. Trump. The cases examine whether the president has authority under the International Emergency Economic Power Act (IEEPA) to impose “trafficking” tariffs on Canada, China, and Mexico for their failure to stop fentanyl traffic and “worldwide,” or reciprocal tariffs on countries across the globe.
“ACD appreciates the Supreme Court’s attention to this issue and on behalf of the millions of small businesses, manufacturers, retailers and other businesses being impacted, urge the Court to expedite its review," said Byer. “The IEEPA tariffs have caused uncertainty for businesses across the supply chain and had a significant impact on ACD members who import and distribute essential ingredients that support Americans’ daily lives. ACD awaits the Court’s decision.”
